Temporary residence through cooperation against organised crime networks
[toc]
What is residence on exceptional grounds for cooperation against organised crime networks?
This is a temporary residence authorization granted to foreign nationals who cooperate with the police, judicial or prosecutorial authorities in connection with organised crime networks, when they are victims, witnesses or injured parties in offences involving the trafficking of labour or prostitution.
This type of residence permit allows you to live and work in Spain.
What is the procedure for obtaining residence through cooperation against organised crime networks in Spain?
Where a foreign national falls into one of the cases described above, the authority with which they are cooperating will issue a report so that the Government Sub-Delegation can exempt them from the offence of being irregularly present in Spain and, consequently, suspend any penalty for that offence.
If the Government Sub-Delegate grants the exemption and suspends the penalty proceedings, they will inform the foreign national of their right to apply for a residence authorization for cooperating against organised crime networks.
If the foreign national decides to apply for a residence authorization, the unit with which they are cooperating will issue a favourable report and send it to the competent authority to decide whether to grant provisional authorization.
Once provisional authorization has been granted, it must be renewed annually until a decision is made on the definitive authorization. The foreign national must then apply for a Foreigner Identity Card (TIE).
The definitive authorization is valid for five years and allows the holder to live and work throughout Spain.
If the application for definitive authorization is refused, the temporary authorization ceases to be valid.
Who must submit the application for temporary residence through cooperation against organised crime networks, and where?
The foreign national must submit the application for temporary residence to the relevant immigration police unit. The application may be submitted in person or through a legal representative.
What documents must be submitted with an application for temporary residence authorization through cooperation against organised crime networks in Spain?
The documents required to apply for residence on exceptional grounds for cooperation against organised crime networks in Spain are:
- Application on the official form (EX-10).
- Copy of the foreign national’s complete, valid passport or travel document.
- Public document granting legal representation to the individual submitting the application, if they are not the applicant.
