Large Companies and Strategic Groups Unit (UGE) in Spain: role and requirements

Large Companies Unit

🚨
Important legislative change — April 2025

The Golden Visa (investor visa) was abolished on 3 April 2025 by Organic Law 1/2025. Since that date, no new residence applications based on real estate or financial investment have been accepted. Holders of Golden Visas already granted and applications submitted before that date may still renew under the previous regulations.

The Large Companies and Strategic Groups Unit (UGE-CE) is the body within the Ministry of Inclusion, Social Security and Migration that manages residence and work permits for highly qualified professionals, entrepreneurs, researchers, posted workers and audiovisual-sector professionals. Its main advantage: a decision within 20 days and 100% online processing.

What is the Large Companies and Strategic Groups Unit?

The UGE-CE is a body established in 2007, under the Ministry of Inclusion, Social Security and Migration, specializing in the management of residence and work authorizations provided for under Law 14/2013 on support for entrepreneurs and their internationalization.

Unlike provincial Immigration Offices, which handle most standard residence permits, the UGE-CE is specifically designed for profiles with high economic value: highly qualified professionals, entrepreneurs, researchers, workers posted within multinational companies and artists. The process is centralized, entirely online and has much shorter processing times.

Its legal basis is Law 14/2013, of 27 September (as amended by Organic Law 1/2025), supplemented by the Immigration Regulations (Royal Decree 557/2011) and various ministerial orders for specific groups.

What authorizations does the UGE-CE process?

The UGE-CE manages the following types of authorization (as of April 2025, excluding the real estate investor visa):

🚀
Entrepreneurs

Foreign nationals who wish to develop an innovative business project of particular economic interest to Spain. A favourable report from ENISA or an equivalent body confirming the project’s innovative nature is required.

🎓
Highly qualified professionals

Workers with an advanced university degree or at least 3 years of experience in the role, duly documented. The Spanish company hiring them must meet certain size or sector criteria.

🔬
Researchers

Scientists and academics who will carry out training, research, development and innovation activities at Spanish public or private entities.

🌍
Intra-corporate transfers (ICT)

Executives, specialists and technical staff at multinational companies who are transferred to the Spanish subsidiary. They must have been with the corporate group for at least 3 months.

💻
International remote workers

Professionals who work remotely for companies or clients outside Spain (digital nomads). They must provide evidence of an employment contract or professional relationship with a foreign company and sufficient financial means.

🎬
Audiovisual and cultural sector

Foreign artists, technicians and professionals who will work in the audiovisual sector or perform artistic activities before an audience in Spain for a period of more than 180 days.

ℹ️

All UGE-CE authorizations also allow applicants to bring their family members with them at the same time: a spouse or registered partner, minor children or dependent adult children, and dependent ascendants.

Advantages over the standard immigration process

UGE-CE Standard immigration process
Processing time 20 days 3 months or more
National employment situation Not required Must be demonstrated
Applying from Spain Yes (no prior visa required) Generally, from the country of origin
Initial duration 3 years 1–2 years
Family included Yes, in the same application Subsequent family reunification
Processing 100% online In person or online, depending on the case

General requirements for applying for a UGE-CE authorization

Although each type of authorization has its own specific requirements, all applicants must meet the following common requirements:

✓
Be over 18 years of age and a non-EU citizen

Citizens of the EU, EEA and Switzerland do not need a residence authorization.

✓
Valid passport with at least 1 year of validity

It must cover the entire period of the requested authorization.

✓
Criminal record certificate

From your country of origin and any countries where you have lived during the past 5 years. It must bear a Hague Apostille and, if it is not in Spanish, be translated by a sworn translator.

✓
Sufficient financial means

Generally, 400% of the IPREM for the main applicant (~2.000 €/month) and 100% of the IPREM for each family member included in the application.

✓
Private or mutual insurance

It must provide coverage equivalent to Spain’s Social Security system: full hospitalisation and no co-payments. This requirement is particularly relevant for entrepreneurs and remote workers.

✓
Documents specific to the applicant category

Employment contract, university degree, business plan with an ENISA report, intra-corporate transfer letter, etc., depending on the type of authorization.

How to submit an application to the UGE-CE

The entire process is completed entirely online through the Ministry of Inclusion’s online portal. You need a digital certificate or must apply through an authorised representative.

1
Access the Ministry’s online portal

Go to inclusion.gob.es/web/unidadgrandesempresas using your digital certificate. From there, you can submit your initial application, attach documents, provide missing or corrected documents, apply for renewals and check your application status.

2
Download and complete the application form

Each type of authorization has its own form, available in the UGE applications section. Complete it with all the details of the applicant and the position or activity.

3
Gather and attach the documents

Documents must be in PDF format and must not exceed 5 MB each. Foreign documents must bear a Hague Apostille and be translated by a sworn translator if they are not in Spanish.

4
Pay the applicable fee

UGE-CE authorizations have their own fees, separate from the 790-026 citizenship fee. The amount varies depending on the type of authorization. The form is available on the UGE website.

5
Decision within 20 days

The maximum statutory decision period is 20 working days. If you are asked to provide missing or corrected documents, you will receive a notification through the online portal and have 10 working days to submit them.

✅

Positive administrative silence: if 20 working days pass without an express decision, the application is deemed to have been approved. This is a genuine advantage over standard immigration procedures, where administrative silence may result in a refusal.

Golden Visa: What changed in 2025

This is the most significant change at the UGE-CE in recent years. Organic Law 1/2025, published on 3 January 2025 and in force since 3 April 2025, repealed Articles 63 to 67 of Law 14/2013, which regulated the residence visa for investors (the well-known Golden Visa).

Situation What happens?
New applications (from 3 April 2025) They are not accepted. The investor scheme has been abolished.
Applications submitted before 3 April 2025 They continue to be processed under the regulations in force on the date of submission.
Golden Visas already granted They remain valid until their expiry date.
Golden Visa renewals They are processed under the regulations in force when the initial permit was granted. The UGE-CE accepts all renewal applications.

The end of the Golden Visa does not close the door to international talent or capital. Authorizations for entrepreneurs, highly qualified professionals and international remote workers remain fully in force and continue to be processed by the UGE-CE with the same benefits.

⚠️

If you have an active Golden Visa and are going to renew it, the timing of your renewal is critical. You must prove that the conditions of the original investment remain in place (ownership of the property, financial investments, etc.). We recommend seeking specialist advice before submitting your renewal application to the UGE-CE.

Frequently asked questions about the UGE-CE

+
Has the Golden Visa definitely been abolished in Spain?
Yes. As of 3 April 2025, Organic Law 1/2025 abolished the residence visa scheme for investors (Golden Visa). No new applications under this scheme are accepted. Holders of Golden Visas already granted can renew them, and applications submitted before that date can complete processing.
+
How long does the UGE-CE take to decide on an application?
The maximum statutory decision period is 20 working days from the submission of the complete application. If no express decision is issued within that period, positive administrative silence applies (the application is deemed to have been approved). This is one of the main incentives for using the UGE route rather than the standard immigration procedure, which can take 3 months or more.
+
Can I apply for UGE authorization while already in Spain as a tourist?
Yes. One of the advantages of the UGE-CE is that applications can be submitted directly from Spain, even if the applicant is in the country on a tourist visa or during a 90-day stay. This is a significant advantage over ordinary permits, which generally must be applied for from the applicant’s country of origin.
+
Can I change employers with a UGE-CE authorization?
It depends on the type of authorization. For employed-work authorizations (highly qualified professionals, ICT), changing companies or employers must be reported to the UGE-CE and, in some cases, you must apply to modify the authorization. A change that is not reported may lead to irregularities in your immigration status. We recommend consulting a specialist before formalizing the change.
+
What is the difference between the UGE-CE and the standard immigration authorities?
The UGE-CE processes only authorizations under Law 14/2013 for qualified professionals. Its main advantages over the standard immigration system are: a decision within 20 days (compared with 3 months), no need to prove the national employment situation, an initial authorization lasting 3 years (compared with 1-2 years), the option to include family members in the same application, and 100% online, centralized processing.
+
What is the UGE at the Tax Agency? Is it the same body?
No. They are different bodies. The UGE at the Tax Agency (Large Companies Management Unit of the AEAT) is the special delegation of the Tax Agency that manages the tax obligations of companies with the highest turnover in Spain. The UGE-CE at the Migration Office deals exclusively with residence and work permits. They have no administrative connection with each other.

Compatibility of residence with employed work and self-employment

The compatibility of residence with employed and self-employed work is a crucial issue for those seeking to establish themselves professionally in Spain. Understanding the requirements and procedures for obtaining permits is essential to facilitating integration into the Spanish labour market.

This article provides detailed information about the current regulations, the requirements to be met, and the application procedures for employed and self-employed work in Spain.

Can I apply for authorization to work as an employee and as a self-employed person?

Yes, it is possible to apply for authorization that allows you to combine employed and self-employed work. However, you must meet certain requirements set out in the legislation in force.

Organic Law 4/2000 and Regulation RD 557/2011 govern these authorizations. These regulations allow holders of an employed-work permit to apply to change it to one that also allows them to work on a self-employed basis, provided they can justify that the two activities are compatible.

If you wish to carry out both activities, you must demonstrate that your self-employed work does not interfere with your employment. This includes factors such as working hours and the nature of the activities.

What requirements do I have to meet to work as an employee and as a self-employed person?

The requirements vary depending on the type of authorization you wish to apply for. Generally, you must meet the following requirements:

  • Proof of sufficient financial resources.
  • Compliance with employment regulations.
  • Proof of the required professional qualifications.
  • At least one employment contract or a business plan supporting your activity.

For employed work, you must have a contract that complies with Spanish employment law. For self-employment, submitting a solid business plan is essential to demonstrate that your business activity is viable.

You should also check the specific requirements for each type of work, as they may vary depending on your personal circumstances and nationality.

Documents to submit with a permit application

The required documents may include:

  1. Application form for a residence and work authorization.
  2. Documents proving your identity and nationality.
  3. Employment contract or business plan.
  4. Documents showing your financial and employment situation.
  5. Criminal record and health certificates, if required.

It is essential to ensure that all documents are properly completed and accompanied by the necessary translations if they are in another language. Failure to provide the required documents may result in your application being refused.

Also bear in mind that the application process may differ depending on whether you apply in person or online, so make sure you follow the specific instructions for the procedure you choose.

Information about the application procedure for authorizations

The process for applying for residence and work authorizations involves several important steps. First, you must book an appointment at the Immigration Office or, if you are abroad, at the Spanish Embassy or Consulate.

Once you have your appointment, you must submit all the required documents. Make sure you include everything needed to avoid delays in the process.

The time taken to decide on an application may vary, but is generally set at a maximum of three months. If you do not receive a response within this period, your application will be considered refused.

During the process, it is advisable to keep track of your application status and be prepared to provide additional information if requested.

Residence and work permit as an employee: what you need to know

The residence and work permit as an employee allows foreign nationals to work in Spain under a specific contract. This type of permit is subject to certain conditions that you should bear in mind.

One of the most important requirements is having an employment contract before applying. This ensures that the worker has a job to support their residence application.

The employer must also show that they have made a formal job offer and complied with the relevant labour regulations. These include requirements such as the minimum wage and working conditions.

The permit may be temporary or renewable, depending on the length of the employment contract and whether the established requirements are met.

Changing from residence to residence and work as a self-employed person: a complete guide

If you already have a residence permit and want to change it to include self-employment, you must follow a specific process. You will need to show that your self-employed activity is compatible with your previous circumstances.

To do so, you will need to submit a business plan explaining how your business activity will be carried out. Your financial situation will also be assessed to determine whether it is stable and whether you have the resources needed to carry out that activity.

It is essential to stay in regular contact with the Immigration Office to ensure that you meet all the requirements and that your application is being processed correctly.

Remember that changing a permit can be a complex process, so it may be worth seeking specialist legal advice if necessary.

Related questions about combining residence and work

Can you work with a temporary residence permit?

You can generally work with a temporary residence permit, provided it explicitly authorizes you to do so. It is important to check the specific conditions of your permit, as some may restrict the type of work or employment you can take up.

Also, if your temporary residence permit is linked to a specific situation, such as studies or family reunification, make sure you check whether there are any additional restrictions that could affect your right to work.

What if I am self-employed and also work as an employee?

If you are self-employed and also want to work as an employee, you can do so as long as you meet the requirements for both activities. However, you will need to show that the two activities are compatible and do not interfere with each other.

This includes making sure that your workload does not exceed the permitted hours and that both activities comply with current labour regulations. It is essential to keep clear records to support your employment situation.

What is a residence and work permit for self-employment in Spain?

A residence and work permit for self-employment is an authorization that allows foreign nationals to set up and run their own business in Spain. Applicants must submit a viable business plan and show that they have sufficient financial resources to sustain their business.

This type of permit is ideal for entrepreneurs looking to start their own business, as it gives them the opportunity to settle in the country while legally carrying out their economic activity.

How can I find out whether I can work with my NIE?

The Foreigner Identification Number (NIE) is essential for carrying out various activities in Spain, including working. If you have an NIE, you should check the conditions of the residence permit associated with it.

The NIE itself does not automatically grant the right to work; you must make sure that your residence permit includes the relevant work authorization. You can contact the Immigration Office for information specific to your situation.

The domestic worker’s contract and payslips

Preparing payslips for domestic workers is crucial to ensure compliance with employment regulations and protect workers' rights. A payslip not only shows the worker's salary but is also a legal document that must clearly and accurately list all applicable earnings and deductions.

In this article, we will take an in-depth look at domestic worker contracts and payslips, as well as the key points to consider when completing this important procedure in 2024.

Is it mandatory to provide domestic workers with a payslip?

Providing domestic workers with a payslip is undoubtedly a legal obligation for the employer. The payslip serves as an official record of the salary and deductions made. It is also essential for ensuring transparency and trust in the employment relationship.

The employer must provide a payslip every month. This is an essential document for workers, as it gives them a clear record of their earnings and deductions. Without a payslip, misunderstandings can arise about salary and employment conditions.

Meeting this obligation also helps avoid penalties and legal problems, highlighting the importance of payslips for domestic workers.

What must a domestic worker's payslip include?

A domestic worker's payslip must contain several key details to be valid and comply with current regulations. These include:

  • Employer and employee details: First and last names and identification number.
  • Pay period: State the month covered by the payslip.
  • Gross salary: Total amount before deductions.
  • Deductions: Social Security contributions, personal income tax (IRPF), among others.
  • Net salary: The amount the worker actually receives after deductions.

It is also advisable to include information about the Social Security contribution account code, which is essential for registration and contributions to Social Security. These details are vital for managing payroll correctly and meeting the employer's legal obligations.

How do you register domestic workers with Social Security?

Registering with Social Security is a key step when hiring a domestic worker. Since 2024, this responsibility rests exclusively with the employer. To complete the process, follow these steps:

  1. Visit the Social Security website or go to the relevant office.
  2. Complete the registration form, including all the employee’s and employer’s details.
  3. Submit the required documents, including both parties’ DNI and the employment contract.
  4. Confirm that the registration has been processed correctly and obtain proof of the procedure.

This process is essential because it ensures that the domestic worker is covered by Social Security, giving them access to healthcare and social benefits. Completing this procedure ensures that the employer complies with the law and helps prevent future problems.

What are the key parts of a domestic worker’s payslip?

A payslip is divided into several sections that are essential for understanding it and ensuring it is valid. The key parts include:

  • Header: Employer and employee details, as well as the pay period.
  • Earnings: A breakdown of payments, such as base salary and overtime.
  • Deductions: Amounts deducted from gross salary, including contributions.
  • Footnotes: Additional information, such as bank details or contract clauses.

Each of these sections should be clear and easy to understand. A well-structured payslip template will help avoid confusion and ensure that both the employer and the domestic worker fully understand the terms of their employment relationship.

What employment rights do domestic workers have?

Domestic workers have a range of employment rights that employers must respect. These include:

  • The right to fair pay: They must receive at least the Statutory Minimum Wage (SMI).
  • The right to Social Security: They must be registered with Social Security.
  • The right to annual leave: They are entitled to a period of leave each year.
  • The right to privacy: Their privacy in the home must be respected.

These rights are essential to ensuring a fair and equitable employment relationship. Domestic workers must be treated with dignity and respect, and employers are responsible for ensuring that all relevant regulations are followed.

How does the Statutory Minimum Wage affect domestic workers’ payslips?

The Statutory Minimum Wage (SMI) is a key factor that directly affects domestic workers’ payslips. In 2024, the SMI has changed, and these changes must be taken into account when preparing a payslip.

Domestic workers must receive at least the SMI, which means that any agreed salary must be at least this amount. This is especially relevant when negotiating contracts and salaries, as paying less than the SMI is illegal.

In addition, the SMI is updated periodically, so employers must keep up to date with these changes to ensure that payslips comply with the regulations in force and to avoid possible penalties.

Frequently asked questions about domestic workers’ payslips and contracts

What is the payslip for domestic workers in 2025?

In 2025, domestic workers’ payslips must comply with the regulations and the Statutory Minimum Wage in force that year. Employers should keep an eye on any updates and be prepared to make the necessary adjustments.

They will include the same items as in 2024, with the relevant adjustments to salaries and Social Security contributions. Remember that adapting to these changes is essential to avoid legal problems.

Is it compulsory to give a domestic worker a payslip?

Yes, employers are required to give domestic workers a payslip. This provides security for both the employer and the worker by clearly documenting the employment conditions and payments made.

A payslip documents and provides transparency in the employment relationship, helping to prevent future disputes and misunderstandings about payments and deductions.

What type of contract do domestic workers have?

Domestic workers usually have an employment contract governed by the Special Social Security Scheme for Domestic Workers. This contract must specify the working conditions, including salary, hours and duties.

It is essential for the contract to be in writing and signed by both parties, as this provides a legal framework that protects both the employer and the domestic worker.

How much does a domestic worker earn?

A domestic worker’s payslip varies depending on several factors, such as the number of hours worked, the agreed salary and applicable deductions. At least the statutory minimum wage must be paid.

The payslip must be calculated accurately to ensure compliance with the regulations and that the domestic worker receives the amount due for their work.

Underage immigrants can obtain a work permit from the age of 16

The recent amendment to Spain’s Immigration Law has brought significant changes to the legal framework for underage immigrants. As of 6 March 2020, underage immigrants can obtain a work permit from the age of 16 years, a measure intended to facilitate their integration into society and the labour market. This regulation not only allows minors to work, but also establishes a framework of rights to protect them.

This article explores the most relevant aspects of this legislation, including the requirements for obtaining a work permit, the rights of underage immigrants and the residence application process, among other points.

From what age can underage immigrants work if they are over 16?

The legislation establishes that immigrants who turn 16 can obtain a work permit. However, it is important to note that they may do so only after obtaining the relevant residence authorization. This means that the process can begin once they reach the minimum age, but they must also comply with the law.

In addition, minors who wish to work should bear in mind that there are restrictions on the types of work they can do. For example, certain jobs are prohibited because the conditions may be harmful to their health or development.

Therefore, although minors who are immigrants may obtain a work permit from the age of 16, they must comply with specific regulations designed to prioritise their wellbeing and personal development. Integrating these young people into the workforce is an important step towards their independence.

What requirements must minors who are immigrants meet if they wish to work?

To obtain a work permit for foreign minors in Spain, they must meet a number of requirements. These include:

  • Be under 18 years of age and have reached the minimum age of 16 years.
  • Have a valid residence authorization.
  • Submit an employment contract signed by the employer.
  • Show that the work will not interfere with their education or personal development.

It is essential that minors are informed about their employment rights and responsibilities. Meeting these requirements not only gives them access to the labour market but also ensures their protection within it.

Employers are also advised to familiarise themselves with the current regulations and ensure that employment contracts comply with them to avoid penalties.

Legislation on unaccompanied foreign minors in Spain

The situation of unaccompanied minors is a sensitive issue in the field of migration. Organic Law 4/2000, enacted by Juan Carlos I, establishes a framework of protection for these minors, ensuring their access to fundamental rights such as education, healthcare and legal protection.

Unaccompanied foreign minors who arrive in Spain are entitled to assistance and protection. This includes the possibility of receiving a residence authorization for minors under guardianship, allowing them to integrate into society.

The competent authorities must also safeguard their interests and ensure they are treated with dignity and humanity. The legislation also establishes specific procedures for assessing their circumstances and accessing available resources.

The rights of migrant children in Spain

The rights of migrant children are protected by various laws and international conventions, including the Universal Declaration of Human Rights. In Spain, minors have the right to:

  1. Receive healthcare and education.
  2. Be protected from abuse and exploitation.
  3. Be heard in proceedings that affect them.
  4. Access legal advice services.

These rights are essential to ensuring the full and effective integration of immigrant minors into Spanish society. Protecting their rights must be a priority for all institutions involved in their care and wellbeing.

It is important that both minors and their guardians are informed about these rights, as they form a fundamental basis for their personal and social development.

Spanish citizenship for minors under guardianship

Minors under guardianship in Spain may be eligible for Spanish citizenship under certain conditions. The law provides that, if they have lived in the country for at least two years and have been under the care of the protection system, they may submit an application for citizenship.

This process aims to facilitate minors’ integration into society, allowing them to access rights that are essential to their development.

In addition, recognition of their citizenship may open up future employment and educational opportunities, helping to build a brighter future.

Residence application process for minors born in Spain

The residence application process for minors born in Spain is relatively straightforward, but specific documents must be submitted. These minors are entitled to Spanish citizenship if at least one of their parents is also Spanish or legally resident in the country.

The application must include documents proving the parents’ identities and legal status, as well as the minor’s birth certificate. Parents should be aware of the deadlines and requirements to avoid any problems.

Once the documents have been submitted, the authorities have a set period in which to decide on the application. It is essential that parents stay in regular contact with the authorities to ensure the process proceeds smoothly.

What are the implications of amending the Immigration Law?

The amendment to the Immigration Law represents a significant change in how the immigration of minors to Spain is addressed. On the one hand, it aims to promote their integration into the workforce, giving young immigrants access to opportunities that were not previously available to them.

On the other hand, the amendment also establishes protection mechanisms to safeguard the best interests of the child. This means that all decisions concerning their immigration status must take their well-being into account.

The authorities are working to implement these rules effectively, which is essential to ensure that minors’ rights are respected and prioritised at every level.

What other measures are being introduced to help foreign minors integrate?

In addition to allowing young immigrants to obtain a work permit from the age of 16 years, various measures are being implemented to support their integration. These include:

  • Mentoring and psychological support programmes.
  • Access to training and education courses tailored to their needs.
  • Community initiatives that promote social inclusion.
  • Awareness campaigns on immigrants’ rights.

These measures are essential to ensure that minors can not only access the labour market but also feel part of the community they have chosen to live in. Effective integration requires the effort and cooperation of all members of society.

What requirements must be met to employ a foreign national?

To hire a foreign worker in Spain, you must meet certain legal requirements. First, the employer must show that no suitable candidates could be found in the local labour market. This process is known as the “recruitment test”.

You must also have the relevant documents, including:

  • The employer’s tax identification number.
  • The job vacancy published by the public employment service.
  • The employment contract signed by both parties.

The foreign worker must have the appropriate work authorization. This permit is an essential document that allows the foreign national to work in the country. To obtain it, certain steps must be followed, including submitting applications and, in some cases, attending interviews.

One important point to bear in mind is that the process for obtaining permits may vary depending on the worker’s country of origin, so it is advisable to check the requirements for each nationality.

How do you hire a foreign worker in Spain?

The process of bringing foreign workers to Spain starts with drafting a clear and precise job offer. The vacancy must be published with the State Public Employment Service (SEPE) and meet the requirements set out in Spanish law.

Once the ideal candidate has been selected, the next step is to apply for work authorization. This procedure is handled by the relevant Immigration Office, and processing times may vary depending on the office’s administrative workload.

It is important to make sure the worker has all the required documents, which generally include:

  • A valid passport.

Yes, a work permit is required to hire non-EU foreign nationals. These permits ensure that workers have the necessary authorization to carry out their duties in Spain. Workers from the European Union, on the other hand, do not need a work permit to access the Spanish labour market.

Work permits are handled through the Immigration Office. It is essential to submit the required documents and meet the deadlines to avoid delays in the process.

A key requirement for obtaining a permit is demonstrating the need to hire a foreign worker. This can be shown by the lack of suitable local candidates for the position on offer.

How does collective recruitment in the country of origin work?

Collective recruitment in the country of origin is a process that allows Spanish companies to hire foreign workers in an organised way. This model is particularly useful for sectors facing labour shortages at certain times of the year, such as agriculture.

The process involves cooperation between the Ministry of Inclusion, Social Security and Migration and the companies concerned. This system can be used to:

  • Organise job fairs in countries of origin.
  • Facilitate workers’ mobility.
  • Provide training before workers arrive in the country.

This collective recruitment process benefits not only companies but also gives workers access to job opportunities under clear, regulated conditions.

Spain’s Ministry of Labour has worked to create programmes that promote the integration of immigrants, helping them access employment and reducing the red tape involved in hiring.

What are the main challenges to integrating immigrants into Spain’s labour market?

Integrating immigrants into the Spanish labour market presents many challenges. These obstacles affect not only individuals, but also the economy and social cohesion.

Financial means the employer must demonstrate to apply for a residence and work authorization

Employer financial means for arraigo social (social-integration residence route)

Hiring foreign nationals in Spain involves a series of requirements and responsibilities for the employer. One of the most important aspects is the financial means the employer must demonstrate when applying for residence and work authorization. This requirement is intended to ensure that the employer can meet the terms of the employment contract and provide stability for the foreign worker.

Immigration regulations have recently undergone significant changes regarding the requirements employers must meet. In this article, we will explore the financial means an employer must demonstrate when applying for residence and work authorization, along with other key aspects of the process of hiring foreign nationals.

What financial means must an employer demonstrate when applying for residence and work authorization?

The employer must demonstrate that they have sufficient financial means to meet their obligations under the employment contract. This includes, among other things, being able to pay the worker the agreed salary. These means must comply with the requirements set out in Organic Law 4/2000 and the Public Indicator of Multiple-Effect Income (IPREM).

The financial means required may vary depending on the employer’s and worker’s circumstances. For example, if the employer is an individual, they must demonstrate that they can afford not only to pay the salary but also to support their family if they are in Spain.

  • Demonstrate the salary offered to the foreign worker.
  • Prove the employer’s financial solvency by submitting accounting documents.
  • Provide information about the business activity and its viability.

These requirements are essential to ensure that the foreign worker has not only a job, but also a stable working and financial environment.

What are the requirements for obtaining a work permit in Spain?

To obtain a work permit in Spain, you must meet a number of specific requirements. These requirements are essential to ensure that foreign nationals are hired legally and transparently.

The main requirements include:

  1. A formal job offer stating the position, salary and contract duration.
  2. Submission of evidence of the financial means the employer must demonstrate, as mentioned above.
  3. Compliance with the labour and tax regulations in force in Spain.

Both the employer and the worker should be aware of these requirements to make the application process easier and avoid potential problems.

How can an employer’s financial capacity be demonstrated during the hiring process?

Evidence of the employer’s financial capacity is a critical step in the process of hiring foreign workers. Several methods can be used to demonstrate it.

Some of the most relevant documents that can be submitted include:

  • The company’s latest tax returns and balance sheet.
  • Payslips and social security contribution records.
  • Bank certificates demonstrating financial solvency.

These documents not only help demonstrate the employer’s financial capacity, but also give the Immigration Office confidence that the contract offered to the foreign worker is viable.

What changes does the new immigration regulation introduce regarding financial resources?

The new immigration regulation has introduced significant changes to the requirements employers must meet when applying for a residence and work authorization. One of the most significant changes is that, in certain cases, employers no longer need to demonstrate that they have sufficient financial resources.

Once this regulation is implemented, the Immigration Office may request proof of financial resources only if there are reasonable doubts about the authenticity of the employment contract. This is intended to simplify and speed up the process of hiring foreign workers.

However, employers should be prepared to submit these documents if requested, particularly if there are any irregularities in the contract.

What types of employment contracts are permitted for foreign workers in Spain?

There are several types of contracts that can be used when hiring foreign workers. The type of contract chosen will depend on the worker’s profile and the employer’s needs.

  1. Permanent contracts: They offer job security and are the most highly regarded.
  2. Temporary contracts: They are used for specific, short-term staffing needs.
  3. Part-time contracts: They offer flexibility in working hours and can be adapted to the needs of both parties.

It is essential that the chosen contract complies with employment regulations and is duly registered, as this will facilitate the application for residence and work authorization.

What is arraigo social (the social-integration residence route), and how does it affect foreign nationals in Spain?

Arraigo social (the social-integration residence route) is a legal pathway that allows foreign nationals who have lived in Spain for an extended period—generally three years—to regularize their immigration status. This type of authorization aims to facilitate immigrants’ integration into the country.

To qualify for arraigo social, applicants must have a job offer and demonstrate ties to Spanish society, such as family or community ties. This process is essential for those seeking to settle permanently in Spain.

Arraigo social also sets out conditions that enable foreign nationals to access rights and services that improve their quality of life and their ability to integrate into Spanish society.

What is the process for applying for residence and employed-work authorization?

The process for applying for residence and employed-work authorization involves several steps that must be followed carefully to ensure the application is processed correctly.

The main steps are:

  • Gather all the required documents, such as the employment contract and proof of financial resources.
  • Submit the application to the relevant Immigration Office, observing the applicable deadlines.

It is essential that both the employer and the worker understand their rights and obligations before signing the contract, helping to ensure a fair and balanced employment relationship.

What are the essential elements of a domestic worker employment contract?

An employment contract for a domestic worker must include several essential elements to be considered legally valid. These include:

  • Identification of the parties: The names and contact details of both the employer and the employee.
  • Job description: The specific duties to be performed by the employee.
  • Pay: Details of the agreed salary and payment method.
  • Working hours: The days and hours the employee will work.
  • Contract duration: Whether the contract is fixed-term or indefinite, and the renewal terms.

Including these elements is important not only for clarity in the employment relationship, but also to protect both parties in the event of disputes. The more detailed the contract, the lower the likelihood of misunderstandings.

How to register a domestic worker with Social Security

Registering a domestic worker with Social Security is a crucial step in formalising their employment. This process involves registering the employee with the Social Security system, giving them access to benefits and employment rights.

To do this, the employer must submit the relevant registration form to the General Treasury of the Social Security. This form can be completed online or in person.

Bear in mind that, in addition to registering the employee, the employer must pay the monthly contributions applicable to the salary agreed in the contract. This ensures that the employee is covered for matters such as healthcare and retirement.

Drawing up a domestic worker employment contract involves several steps to ensure it is legally valid. First, it is essential to know which documents are required, including:

  • Social Security registration: Register the employee with the relevant system.

Once all the documents have been gathered, the next step is to sign the contract in front of witnesses, if possible, which gives it greater validity. Finally, keeping a copy of the signed contract is essential for any future procedure or enquiry.

What is an indefinite-term contract for a domestic worker?

An indefinite-term contract has no set duration, allowing the employee to work without a predetermined time limit. This type of contract offers greater security for both the employer and the employee.

The benefits of an indefinite-term contract include greater job stability and the possibility of receiving certain benefits, such as compensation for dismissal. It is also important to ensure that the minimum wage is respected and the relevant Social Security contributions are paid.
